PUBLIC MEETINGThe Board of Adjustment and Building and Standards Commission met on Thursday, November 19, 2009, at 9:00 a.m. in the Council Chambers at the City Hall Annex, 115 SW 1st Street, Mineral Wells, Texas to discuss the following:RESULTSSubstandard structures to be considered for possible condemnationPUBLIC HEARING ON BSC CASE 2009-14 On May 21, 2009, a substandard structure owned by Mauricio Velasquez, 605 Pasadena Blvd., Lot 16, Block 7, Pasadena Heights Addition was condemned by the Building and Standards Commission. The structure has not been demolished at this time and the property owner requested the opportunity for a public hearing to temporarily remove the structure from condemnation and permission to bring the structure up to code. Public hearing was held July 16, 2009. PUBLIC NOTICEREQUEST FOR RELEASE OF FUNDSOn or about December 8, 2009TDHCA will authorize Mineral Wells Pioneer Crossing, LP to submit a request to HUD for the release of Tax Credit Assistance Program funds under Public Law 111 – 5 of the American Recovery and Reinvestment Act of 2009, as amended, and HOME funds under Title II of the National Affordable Housing Act of 1990, as amended, for HOME contract number 1001114,undertake a project known as Pioneer Crossing of Mineral Wells,for the purpose of new construction of an 80 unit multi-family development at 2509 East Hubbard, Mineral Wells, Palo Pinto County, Texas. The total cost of project is $8,273,007 and the amount of home funds utilized for this project is $2,972,073.FINDING OF NO SIGNIFICANT IMPACTThe TDHCA has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 221 East 11thStreet, Austin, Texas 78711 or Mineral Wells Pioneer Crossing, LP at 2509 East Hubbard, Mineral Wells, Texas 76067 and may be examined or copied weekdays 9:00 A.M. to 4:30 P.M.PUBLIC COMMENTSAny individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to TDHCA. All comments received by December 7, 2009 will be considered by the TDHCA prior to authorizing submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing. RELEASE OF FUNDSThe TDHCA certifies to HUD that Sandy Garcia in her capacity as HOME Program Administrator consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Pioneer Crossing of Mineral Wells, LP to use Program funds.OBJECTIONS TO RELEASE OF FUNDSHUD will consider objections to its release of funds and the TDHCA certification received by December 28, 2009 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the TDHCA approved by HUD; (b) the (RE) has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD Fort Worth Regional Office at 801 Cherry Street, Unit #45 – Suite 2500, Fort Worth, Texas 76102. PUBLIC NOTICEHISTORIC BRIDGE AVAILABLEThe Federal Highway Administration and the Fort Worth District of the Texas Department of Transportation (TxDOT) announce the availability of a National Register of Historic Places-eligible bridge for relocation and preservation. The concrete slab bridge with masonry substructure is located in a rural setting on FM 919 at the Panther Creek Relief channel approximately two miles north of Gordon in Palo Pinto County.The bridge was built in 1940 as part of a Works Progress Administration (WPA) roadway project. The existing bridge is 47 feet in length and composed of four spans. The concrete slab superstructure has raised, rectangular-shaped, concrete curbs that flank the asphalt-surfaced deck. The substructure consists of three interior masonry piers, two masonry abutments, and four masonry wingwalls. All of the masonry elements of the bridge substructure consist of rough-cut limestone blocks laid in regular courses. The overall width of the bridge is 26 feet with a clear roadway width of 24.6 feet.Technical difficulties and substantial costs associated with relocating and reconstructing the bridge should be anticipated. Limited financial assistance is available to help with relocation costs. The Fort Worth District of TxDOT will be accepting re-use proposals until December 14, 2009.
